What it holds

One thing: whether a driver is prohibited from performing safety-sensitive functions. The records behind that answer are verified positive tests, adulterated or substituted results, an alcohol confirmation at 0.04 or above, a refusal to test, and an employer's report of actual knowledge of on-duty use.

It holds no negatives, no medical information and no opinions. That narrowness is why a clean query is fast and why a hit is unambiguous.

Full and limited queries

A limited query that comes back clean ends the matter for the year. A limited query that says information exists starts a 24-hour clock: the carrier must run a full query within 24 hours, and until it does, the driver may not perform safety-sensitive functions.

Consent, and where it lives

The two consents work differently and carriers mix them up constantly. Specific consent for a full query is given by the driver inside the Clearinghouse itself — the carrier cannot collect it on paper. General consent for limited queries is collected by the employer, on paper or electronically, and the employer keeps it for three years.

The annual query plan

The requirement is at least 1 query per driver per year, which means each driver needs one inside every rolling twelve months — not one per calendar year with a fourteen-month gap in the middle. Carriers that run all queries on 2 January discover the gap two years later.

3. 03Save every query receipt into the driver's file; the receipt is the evidence, not the calendar entry.
